Q: I have a knee injury that now the surgeon is saying he dont think he can repair. what comes next?

I have been on w/c for 6mths. I have a torn meniscus and a torn cartilage. the tears caused me to get fracture in my knee. the surgeon needed the fracture to heal before doing surgery. My last appointment the new MRI showed him better detail and he said the fracture is healing but he dont think surgery will help me now.Also that they cant fix themselves and I without them being fixed yes I will be prone to get more fractures since im bone on bone. So he gave me a cortisone shot (which did nothing) and said he will see me in a month. well my question is if he cant fix this now what?? I cant go back to work doing what i was doing since i cant run,jump, climb stairs,kneel, or even walk for very far.how long can i receive w/c ? if they offer a settlement what kinda settlement would be worth loosing my knee for??very confused. workers comp rep said something about he needed to ask the dr if he was claiming me to have maximum medical impairment. now what? Is this good or bad for me?

A: First, you can see a specialist of your own chosing. Second, with a serious injury you need to speak with a member of the Pa. Assn for Justice that handles workers compensation. They give free consultations. Call me if you need names of some. As far as settlement, until you know your longterm outcome, I'd suggest you hold off. When you do, as you will need medical, you don't want to sign off on medical payments. I'd suggest you contact the Office of Vocation Rehabilitation to know your work options.
