An estate is opened by filing a Petition with the Register of Wills. The law lists people with priority to serve as personal representative (starting with the person named in any Will, then spouse, children, etc.). The post doesn't state whether the son is a minor - if an adult then presumably he would have priority to serve.
If none of the decedent's relatives want to serve in the role of PR, then anyone else who is willing can petition. This is done by bringing the petition, list of interested persons and death certificate (plus the Will if one exists) to the Register of Wills.
