Q: What do I do if manager of my apts refuses to fix leaking ceiling proper & won't give landlord info to file small claim
Our bathroom ceiling has been leaking since we moved in in 2014 they are aware its been going on since we moved in. On a few occasions my toddler son slip and fell due to floor being wet from it. The only time that we can get them to fix it is by calling the city code enforcement and even then they have had to be told multiple times by them to fix it. They send maintenance in to fix it and it starts again a month or so later so they don't fix the issue they just replace drywall on ceiling. I have asked for the landlord info multiple times they say they don't have to give info which I know is illegal. We want to take them to small claims court to break our lease and have them pay for us having to move. We have pictures from when it started happening in 2014 to now. We have wrote a letter and hand delivered it while recording that I want the landlord info they still refuse. got management company info but it is located in Cali we are in Texas. Who do i take to court in this situation?
A: The county appraisal district likely has the information, which is typically online and searchable by address. That will give you the entity that owns the building and is responsible for repairs. Then the Texas Comptroller's website will have information on that entity name, such as the Registered Agent and Registered Agent's address (where the entity should be served).
