Greenville, RI asked in Child Support for Rhode Island

Q: I am still paying child support for my daughter however she lives with me due to abuse. Not sure what to do

My daughters mother made a very big mistake and had our daughter psychology tested. At first when I got the report it was really bad against both of us however we found out that the questions asked were about who she actually lives with at the time. A new test was given regarding her mother and due to emotional and physical abuse she now lives with me. Though I was court ordered years ago for 400.00 a month I was giving my x-wife 1200.00 a month. I did revert back since my daughter has been with me for the original court order of 400.00 but need to change this. I do not want to get anything from her but do not wish to continue child support to a woman that my daughter does not want anything to do with.

A: When circumstances change, the court has no way to know -- short of you (best through a good attorney) filing a motion to modify based on those changed circumstances.
