Q: Can I take a pest company to court if I feel like they didn't deliver the service they promised?

I hired a pest control company to take care of the pest problem I was having in my house. A few weeks later the pest were back even though they guaranteed me they would be gone. I've been calling them ever since and they keep coming out to my property saying they fixed the problem but I am still seeing the pest. Can I take them to court?

A: Sure but it will cost you more to sue than you paid them. Even if you paid $300 for the call, the filing fee along is around $100. Plus summons and serving them, another $50. It makes zero financial sense. Hire another company and move on.

A: You should have a local lawyer review your contract with the pest control company. You may have a cause of action for breach of contract if the company did not provide you with the promised result.
