Valhalla, NY asked in Landlord - Tenant for New York

Q: My landlord is harassing me and threatening me. I have called many places and no one will help. Advice? Help?

I have a signed lease and my landlord is breaking multiple items on the lease. He has threatened to evict me for nonlegal reasons and since the court will not give him an eviction he is harassing and threatening me to leave. The police have stated to him to not harass or confront me. He continues to do so and will not return my last month check or security and states I owe him money instead. I do not feel safe but have no money to go anywhere else and if I leave he says I will be breaking the lease. I even went to the county clerk for help in filing a form against this and they were no help (stating they legally could not tell me what form it was). I feel like I have no recourse but to continue enduring this mans abuse. He has now threatened to throw my things away, has already entered illegally in my space and continues to state he doesn't need to abide by any law.

A: Try a restraining order, if applicable. He might also be in violation of your lease agreement and state housing laws if he's entering your home without sufficient notice. Have an attorney review your lease and the facts to determine whether he owes you money relating to your security deposit.
