Q: I got injured at work and got a contusion in head can i file a lawsuit against company?

The day I got injured I got drug tested and file the report. I requested to go to a hospital but they insisted I talked to a nurse over phone. I been having headaches the day after the incident I stayed home because of the contusion, next day I went to work but I had to leave because of pain. I also went to go see a doctor that same day. What can I do in regards my case? I feel like the company doesn't even care about there employees, I felt neglected.

A: First, make sure they are a "subscriber" as defined by the WC Act. You can either go to the DWC website or call them. Next make sure you file a DWC-41 (report of injury) with DWC. Your employer may not have completed the written report of injury.

Next, if the employer has WC insurance, find out if the employer and carrier have set up a medical provider "network" for medical benefits. If so, very sorry you must see one of their doctors. If not you may choose a doctor to give your care and treatment. Good luck to you.
