Q: My employer is refusing to pay out workers' comp benefits because they are accusing me of saying my injury is more

than it actually is. How do I refute this?

A: If you are being refused treatment, it may be necessary to retain counsel and request a hearing. You will need medical evidence to support the claim.

A: If your employer or its insurer is disputing your right to compensation and medical care, then you need to file a Claim for Benefits with the Virginia Workers' Compensation Commission. Call 1-877-664-2566 to request a claim form from the Commission. That being said what you need for medical care is usually dictated by the treating doctor. This is a medical decision. This is not made by the employer. If the employer won't cover it, then you may have to self-pay in order to obtain a recommendation from the treating doctor. If you have a serious injury, then you may want to contact a Virginia workers' compensation lawyer for representation.
