Q: how do I change child support based on my ex NOT spending the required time w our kids & refusing to add monthly suppor?

My ex demanded in mediation that he get the children 6 weeks for his vacation time. 2 weeks in summer, 1 week in winter, 1 week in spring, and every single Monday holiday. To this date he hasn't spent 1 Monday holiday nor any vacation time at all w the kids and very often is "unavailable" on the weekends he's supposed to have them. I brought this to his attention & he responded by saying he's unable to spend his vacation time w our children (even though he did spend his vacation time, just NOT w our kids) and he's also unable to change child support, claiming he can barely pay his bills. Last month, he rented out the room he has for the kids to a roommate, cutting all his costs in half & now leaving nowhere for the kids to sleep when they are with him on weekends. My child support is automatically taken out of his paychecks. How do I go about changing child support amounts based on him NOT spending the time he is supposed to be spending w the kids, w/o all the crazy lawyer fees?

A: Have you contacted the Department of Child Support Services in San Diego County? They should be able to help you do a modification, but it might take a long time. The county DCSS doesn't charge a fee for modifications, but they have a lot of people seeking modifications and relatively few resources so everyone just has to wait.
