Q: I filed an appeal to the New York Appellate Division regarding a discrimination lawsuit

My suit was filed under the New York City Human Rights Law and the Human Rights Law for the State of New York. Sua sponte, and without notice to me, the Appellate Division dismissed my appeal on completely different grounds than those upon which my appeal was based. In addition, the Appellate Division dismissed my entire case without having evaluated it under Bennett v. Health Management and the New York City Human Rights Law. The central issue of my case is that, in violation of Bennett, my former employer never articulate any reason for my termination. Furthermore, I can show that I am black, was qualified, was terminated, and was replaced by a white male. How can I appeal the Appellate Division's decision to the Court of Appeals?

A: I am sorry to hear about your situation. Without actually looking at all of your matter's paperwork telling you how to file an appeal may not make sense.
