Q: How I can get my divorce/custody finalized when ex doesn't cooperate and is absent father 1+yrs, Attourny not respinsive
Filed Divorce/went to meation 10/2015.Dad doesn't comply, skips town&changes contact info +1yr(last saw child 12/25/15)cant coparent due to absence. Followed Attournys advice with some concerns involving daycare since Dad is missig.Requested for full custody 10/2016 dad no shows to court dates.Dad shows up out of no where about nov 2016 wanting Visitation, lies, intentionally reschedule hearings& no show repeatedly hurting my job. We agreed to dad child visits for 3 Saturdays during November/December holidays to later discuss future plans then expects to have every Saturday even when aware of schedule inability due to child having obligations on Saturdays-Suggested different options,he denied &said he will follow up with me next day- been a week now with no reply. Tried calling attorney 3wks now-office won't respond calls/emails. Texted personal# says he will call me to "square it out"but I'm upset- 2yrs no no progress even when my case is easy and should have been done long ago
A: The first hearing was probably a request for order (RFO). RFO's are not trials. You may need to request that the case be set for trial. It sounds like negotiations have been going on, but when negotiations fail, litigation is generally necessary to move the case forward. It's not unusual for hearings to get continued once if somebody isn't served or even if someone doesn't show up to court. You state there were agreements, but they might not have been court orders.
