Q: My son was born in Mexico 6 months before i became a naturalized U.S. citizen. How can i get him u.s. citizenship?
Hello, My name is Nestor and i live in Tucson Arizona. i became a naturalized U.S. citizen in 8/8/2008, my son was born in Mexico in 8/15/2008 six months before i became a U.S. citizen. My son still lives in Mexico. He is 8 years old. Me and his mother were never married. his mother is not a us citizen nor has a green card. I have always lived in the United states since i was 11 years old. I have never lived in Mexico or in a different country other than the United states. Please help me on how to get him U.S. citizenship. When he was born i signed the birth certificate and he has my last name too.
A: Hi Nestor, if your son was born in Mexico before you became a US citizen, and his mother is not a citizen, you would most likely need to petition for him to enter the USA as a permanent resident. Once he enters as a permanent resident, he will acquire citizenship under the Child Citizenship Act of 2000 as long as he is in your legal and physical custody (even if shared).
