Asked in Family Law and Criminal Law for Texas

Q: My husband's ex-wife keeps harassing me but no one will do anything because we relocated. What can I do?

She used his SSN to have our power turned off, sends me pictures of dead children because all of my children died and she lies on me. I have only seen her in person twice so I wouldn't know her if she were in my face but she's on my background as my sister.

She made a false document with a judge's signature lying about the amount of child support my husband had to pay.

A: FRAUDULENT USE OR POSSESSION OF IDENTIFYING INFORMATION

Fraudulent use of Identifying Information is a State Jail Felony punishable by up to 2 years in state jail.

Sending images of dead children is misdemeanor Harassment punishable by up to 180 days in County Jail but if she did it on multiple occasions that is Stalking, a third degree felony punishable by up to 10 years in the state penitentiary.

The false child support document is the crime of Fraud and also the crime of Simulating Legal Process, both of which are misdemeanors punishable by up to 1 year in County Jail.

What can you do? You could report it to the police but they are likely "too busy" to get involved if they don't think violence is imminent. If she committed the crime of Stalking, you can seek a protective order under Chapter 7A of the Texas Code of Criminal Procedure. This will be a court order that prohibits her from communicating with you at all except through attorneys and will also forbid her from coming near your residence or workplace.
