Nolensville, TN asked in Business Law and Employment Law for Tennessee

Q: office manager advertised that we were covered by ins. plans only to find out we aren't; she left, not covered and $ los

I am the provider/owner of a health clinic. We hired a person, who came with 'experience' to be a consultant to set up our practice. We had no written contract. After many errors were found, among other issues, she was 'fired' in January. She began working in August. I Have emails and info. that she claimed I was covered by insurance groups; I saw patients and no reimbursement. I called mx insurance companies to discover she had not done any contracts. I'm without any pay and now have to do major damage control as she advertised on the web, social media and in the community that we were contracted. We paid her in excess of 15,000 to "set up this practice" as far as credentialing, insurance and social media. She has cost me a tremendous amount of money to 'fix' her errors and now to find out the insurance contracts were not in place, emotional and financial burdens for the last 6 months.

A: You should consider filing suit against this person for fraud and/or outrageous conduct. Perhaps you could recover some of the losses you have sustained. However, litigation is expensive, and time consuming. It could also be that all your remaining resources should be devoted to fixing/correcting the issues you have described.

This is a difficult business decision, many lawyers offer a free initial consultation. Talk to more than one and other trusted friends before you decide. Do not make a decision out of anger.
