Pleasant Hill, CA asked in Child Support, Family Law and Military Law for California

Q: Can child support payments be legally put on hold while a veteran attends an in-patient treatment program for PTSD?

I am trying to help a combat veteran who is suffering from severe PTSD. He is going to counseling through the VA every week or 2, but he needs more help. All he does is go to work and play a game on his phone. His ability to perform normal life functions has gone downhill significantly this past month. His hygiene is getting worse, his room is an uninhabitable dumpster, he has memory problems, depression and no motivation to change his situation because he feels there are too many obstacles. Everything government-related takes too long to see results so he gets discouraged easily. He knows he needs more help, and would consider an in-patient rehabilitation program but he is afraid he will go to jail for not paying child support. Is there away for him to put child support payments on hold so that he can quit his job temporarily and enter a rehabilitation program?

A: He can seek to modify child support payments via a court filing evidencing the financial changes in his life. The best first step is an Initial Consultation with an Attorney.
