Q: If you and your child have already established yourself and moved outside of state, before court order has been made

I have been the primary care giver to my daughter since birth, to current. she is age 3, she has always lived with me. We live in North Dakota. We were getting ready to move to Michigan, and I already have a job and daycare lined up, and my boyfriend is there also. Aaliyah's father in ND has failed to constantly pay child support, i have allowed him to visit her in ND supervised at his moms house. We are already established in MI, and Now he filed to take me to court, and the State says I can't leave with her out of ND unless a court agreement is in place, He agrees, or if the court gives me the okay to leave. What should I Do? And what to I ask the court for so We can leave before the actual battle for custody starts? If we are already established in MI and I have a job lined up, can they force me to stay in ND? Ill loose my job, and her daycare at Head start, everything i established if We don't go!
