Tampa, FL asked in Consumer Law, Libel & Slander and Personal Injury for Florida

Q: Can I sue the gas station employee and the corporation?

A gas station attendant called me names and got upset because I could not understand him. Police were called he lied and said my boyfriend punched him in his face. Videos shows it never happened he was never touched. Police told us and the manager that we were allowed to go back to the store. This all happened on the 15th or 16th of Feb just last week. I visited the store again on Saturday 25th. When i went into the store I saw the store man who involved, so I asked another employee to help me so I didnt have to bother him or be treated like an animal again and to avoid confrontation. While she was trying to open the register and window to help me. The man came to her window opened it and told me and my children we were not allowed in the store. He even went as far as snatching a Pepsi soda out of my 5 year old sons hands an then telling him he wasnt allowed in the store with his mother. The store was full of people how embarrassing and humiliating he again called the police on us.

A: It doesn't look like you have any damages, so you therefore don't have a lawsuit. Telling false things about you or your boyfriend is not slander unless it is believed and thus actually harms your reputation.

Technically, snatching the soda out of your son's hand could be a battery, but again, with no damages it's a matter of "no harm, no foul".
