Sacramento, CA asked in Legal Malpractice for California

Q: My lawyer says I have to pick up the copy of my file at his office. I said I'd pay to ship to my home. He's refusing to

I have been asking for 4 weeks to get my file & my lawyer has crazy excuses. It's a 15 min. copy job, or 30 min. scan to file job. It's a reasonable request, & easy to box up, & ship or put CDs of scans in envelope & mail. He wants $1,000 to download JUST emails. I said NO, please just copy/scan the hardcopies. It's been going round & round for 4 weeks. Do I have to hire another attorney to get the 1st one to give me my file, or can the American Bar Assoc. FORCE HIM TO SHIP IT TO ME?

A: He has to make it available to you. By saying you can pick it up at his office, that suffices. He can charge you for his fees and expenses to copy and send it to you. More details are necessary to provide a professional analysis of your issue. The best first step is an Initial Consultation with an Attorney.
