Q: I have a lifetime medical benefits award, who pays for my lost wages while I'm out of work for surgery?

A: More information is necessary to answer this question. In general, when you are unable to work due to surgery that is covered under your award the employer should pay wage benefits. However, certain limitations may apply.

A: If you have a lifetime medical award and if you are taken out of work for surgery, you can ask for compensation for being out of work provided you are either within two (2) years of the accident date or within two (2) years of the date you were last paid compensation for this injury. You should check with the Virginia Workers Compensation Commission to see if you are still within the time limits to ask for compensation. That phone number is: 1-877-664-2566.
