Menifee, CA asked in Construction Law and Contracts for California

Q: Does a GC have to provide a sub with copies of conditional waivers that sub signed.

a general contractor owes me on 22 jobs. i filled out conditional waivers with my invoice amount that he turned into Home Depot to recieve payment but will not pay me. He is stating he didnt know the price of my invoices. BUT the price was on the conditional waivers that he gave to Home Depot in order to recieve payment. AND all my jobs were invoiced the same, T&M. Does he have to provide me with a copy if i request them. If he did not agree with the amount, why would he have turned it in in order to recieve payment? please help me on this question. Do i have a right to request from him copies of the conditional waivers???

A: You should have kept copies of the contracts you signed. If you have a contract dispute, you can either resolve them via negotiations, ADR, or court. More details are necessary to provide a professional analysis of your issue. The best first step is an Initial Consultation with an Attorney.
