Q: Physician contract
I am a Physician and had signed an employment contract with another physician 4 years ago which I could not honor due to personal reasons. 4 years down the line he is suing me. Yes, it was wrong that I did not join him but I gave him ample notice and I just did not feel comfortable taking up the job. I did not join even a single day. If he wins the court case for damages he claims to have lost because I did not join him and I donot want to pay him am I legally liable to pay him? Will I be forced to pay him if he wins? He is just being difficult as there is no reason to sue , you cannot force someone to work with you, and I donot want his maliciousness to win. it is bad enough that patients can sue you its sad a colleague would. I donot want to pay this malicious physician.
A: It sounds like you're being sued for breach of contract. Why did he wait 4 years? Laches, among other possible defenses, may be a defense.
