Q: Have bench warrant.traffic violation. Recently got pulled over. Alcohol level over limit. Got court. Going back to jail?

A: Depends on the court that your case is in. Certainly that set of facts would cause some concern about bail being set and you going in to custody, yes.

The judge is normally going to look at your total history, including history of not appearing for court dates. They will also consider the facts of the current case, and your personal situation. Employment, time in the community, these things all matter.

If you can, it's a good idea to get a lawyer hired before you appear in court. If you can't, there should be a public defender there who can give you some advice.
