Q: RE: -750 ILCS 5/530(d)1...Is it true no judge factors this into a settlement? That is what current counsel tells me

I'm in the middle of a divorce settlement and feel like I'm not being told the truth. I've spent $100s of thousands to fight an ongoing frivolous lawsuit with my ex--specifically her trying to relocate my 2 year old daughter. The money I used was from an account which only I had ever put money into. When I cited 750 ILCS 5/530(d)1, my attorney said no judge will consider that. I'm being told I dissipated a marital account and I should therefore reimburse her for half what was spent. I feel like my current counsel just wants me to settle because they have milked me for enough and want me to move on.

Does any court take into account the actual law? What is the purpose of having this as part of the law if no one applies it?
