Q: Was hit by a truck 13 mo. ago , can't get him to send ins. info. I've so far had back P.T.& rotor cuff operation
I was fired from work although the semi hit me & was he ticketed & my seat failed so that's their excuse to fire me . ( that dropped workman's comp aprox.$850.00 to $252.00 ) I got a bad arm burn from the belt , then thrown to the pass. side of my truck which hurt my lower back ,and I had major rotor cuff surg . The trucking co. I worked for would not give me a copy of the accident report showing the other drivers info.(once I handed them the only original report at their office , the day of the wreck) & that driver lives out of state . I had one lawyer , but he said the other driver would not return calls or written request when they tried to contact him ,(in Indiana) so they didn't want to spend any more time on the case .
I went through Phy. Therapy but my back is still not right , I had major rotor cuff reconstruction & almost out of approved visits & I'm told my shoulder will probably never be as it use to be .
Need Advice , I have bills but can't work yet.

A: If you filed a claim in Texas and you are covered by a workers' compensation policy, then 100% of your medical bills should be paid for. You are required to use network doctors if you Carrier is in-network. I would advise you to call a workers' compensation attorney of your choice. Most will speak to you for free over the phone. My office does. The attorney will need to get into a few more specifics of your case to give you sound advise.
A: Contact a member of the Texas Trial Lawyers. They give free consultations. As Mr. Graham says comp should cover your injuries. The out of work you'd discuss with the attorney--however some states allow you to use any wage loss you have on the car's policy to cover what comp doesn't> You should be able to get a copy of the report from the police department. That will list the insurance company, owner of the vehicle, etc.
