Q: What documents should we provide for late filing of I-751. Reason being late (mother's death in Philippines)

My wife is one month late filing

A: As noted in the instructions to the Form I-751: "If your failure to file was through no fault of your own, you may file your petition late with a written explanation and request that USCIS excuse the late filing. Failure to file before the expiration date may be excused if you demonstrate when you file the petition that the delay was due to extraordinary circumstances beyond

your control and that the length of the delay was reasonable." Were you or your wife in the Philippines attending to matters related to your/your wife's mother's death. If so, provide copies of the flight itinerary, a copy of your mother's death certificate, copies of funeral documentation (if available) and any other documentation that supports your claim. A detailed affidavit from you and your wife would also be helpful. Contact a reputable and competent immigration attorney if you feel as though you need help.
