Cedar Park, TX asked in Immigration Law for Texas

Q: Hi, Should I apply for my H1B visa stamping based on current I-797 or my latest approval notice?

my current I-797 is valid till 8/30/17 and I applied for visa extension and got recently approved from 8/31/17 to 2020. I am planning to go for visa stamping next week and was wondering should I fill in DS-160 based on current I-797 which is valid till Aug? Or can I apply for stamping based on the latest I-797 which is valid from 8/31/17 through 2020. Thanks.

A: If your extension is through the same (existing) employer, you should submit both (the existing approval notice and the new I-797) for the visa stamping purpose. The consulate should be able to issue you a visa valid till 2020.
