A: Normally, you consult with a medical malpractice attorney who will have the records reviewed by a medical expert.

Most malpractice cases are done on a contingency basis so you only pay if you collect.

A: You must first retrieve all of the hospital/medical provider records. Then a physician in the same or similar practice of medicine must be able to review the records with an eye towards whether or not the acts or omissions that took place before, during or after the surgery was done below the standard of care and if so, whether that deviation from the standard of care was a cause of the injuries, harm, death.
