Q: My daughter was taken from my ex girlfriend for endangerment, neglect , and abuse will i be able to get full custody?

i just want full custody of her will i have a chance in court ?

A: That depends on a number of things. First, are you the legal father, either by an acknowledgement of paternity or a paternity determination by a CSEA. If not, you are out of the game until the legal relationship between you and the child is established. Second, were you involved in the circumstances that resulted in the child being taken by a CPS agency. If this is a CPS case, a case plan will be developed by CPS with the stated goal of reunifying the mother and child. If you are indeed the legal father, and you were not part of the problem, you should contact the CPS agency and make your wishes known. If a case has been filed with the Juvenile Court, and you are the legal father, you should have been notified of the court action. The court must act in the child's interests.

A: Of course there is "a chance." It might even be likely. But there is no way to predict what a court might decide. A court must determine what is in the best interest of the child depending on all the facts and circumstances. A court might determine that neither parent is suitable to care for the child.
