Q: Can you get a citation mailed to you in state of PA if it wasnt issued on the spot of accident?
My daughter got into accident going around a curve and she swerved to avoid hitting something and ended up in an embankment. Got a citation in mail for "driving at a safe speed". The police did not see the accident and were called after it happened. The roads were wet, so no skid marks, and no way to determine speed. Can they mail it, and how can they charge something where this is no evidence of rate of speed?

Not sure why they didn't write it up on the spot, but if you run off the road the implication is you 1)weren't paying attention or 2)fell asleep at the wheel or 3)driving distracted or 4).......driving too fast for conditions (which is what "unsafe speed" is about).
