Partlow, VA asked in Civil Litigation and Consumer Law for Virginia

Q: My truck was repossessed. The bank did NOT send me written notification of repo or auction date and time. What can I do?

I was trying to sell my road tractor with the help of a dealer. I contacted the bank and let them know I was having a problem and could no longer make the payment and where the truck was sitting for sale. There were several phone conversations with the lady at the bank including a conversation with her and the dealer that had the truck listed. When it was all said and done the truck was "repossessed" in Dec 2016. I never received anything in writing about the repossession, auction date and time and when I called the bank I was told the vehicle "had" to go to auction. In Feb 2017 I received notice the truck was sold at half of what I owed on it. The dealer that was supposed to be helping me sell the truck ended up with the truck back on their lot after the auction. The bank is now trying to place a judgement against me. I recently pulled a vehicle transcript report from DMV that show the a disposition date of Sept 22,2016. Something is not adding up. What are my rights at this point?

A: You may be entitled to bring a claim in Court against the bank. It will get involved and may be expensive. You should consult a lawyer in your locale for advice.
