Q: I have cared of my granddaughter since her birth. Her mother lived with us but never cared for her. Her mother moved
to Fl. and We travel back and forth, My grandD is always with me and never left with her mother. I have our flight info proving she has been with me in Rhode for months at a time. My grandD is 9 and doesn't want to go back to Florida . She wants to stay here in RI and attend school, she has been homeschooled by me up until now.Family is here. She takes dance and her friends are here. Now all of sudden my daughter who has never washed, dressed, fed, or really cared for my granddaughter ,other than a few hours at a restaurant or park per month, wants her to go to live with her alone full time. She has a suspended license, no car, in and out of jobs,Men in and out of the house, no real home( hotel),no medical insurance or child care. She has a history of violence, Domestic V and Shoplifting charges here and in Fl. She has a history mental health issues dating back to 5thgrade now untreated. Can she force her to go back to Florida while she is living in Rhode Island with me? I fear for her
A: If she is not willing to consent to allow you to be the guardian of this child, or even if she is, you will do well to enlist the assistance of one of our practicing family court attorneys to assist you.
