Q: What are my rights

I was in an abusive relationship to which my daughter was born. I have since left said person and am married with two other children. I went to file a petition for name change so my daughter who lives with us full time may have the same last name as her brothers and mom and dad. My daughters bio father just recently had a stand off with police bc he locked himself in a home threatening to kill himself he is unstable. I wrote an affidavit asking that the need for him to sign on her name change be waived but he caught wind of it and went to the court house to object anyways. In his objection he put that he wants to establish a regular visitation schedule which was never a thing between him and I. I was allowing my daughter to visit her grand mother(her dads mom) but that's no longer. He has never paid child support and ideally I would like for my husband now to be able to adopt my daughter he's raised her as his own since she was 8months old.
