Pelham, NY asked in Family Law for Massachusetts

Q: Is it right to choose a weekend that I'm entitled to on the defendants holiday?

The defendant had denied me Mother's Day weekend with our minor children. I had filed a contempt of court and both parties had agreed that I have the right to make a weekend with the minor children of my choosing. I feel it's only right that I take one of the defendants holidays. It's only fair. This weekend (6/23/2017) falls on my weekend of my parenting time even though he's entitled to it because his holiday falls on that weekend. There were no mention of not having to choose my make up time on his holiday. I get to choose the weekend, meaning I can choose any weekend regardless of his holiday falling on that date (6/23/2017-6/25/2017).

A: You may want to negotiate via counsel a parenting plan to avoid such disputes, or you may want to file in court seeking such a plan to be made into a court order.
