Q: Seller is stalling, now 2 weeks past closing date. Our time is running out. What damages can we get/request?
They have tenant that "isn't ready to leave". We are racking up bills with moving/storage. Does seller have the right to agree to how much damages and when to pay?
A: I am not able to give a precise answer without reviewing the Contract. The Contract will have the provisions for damages available if Seller defaults. You may want to review the Contract and consult with an attorney to determine your options. Best of Luck!
A: Best suggestion is for your to consult with an attorney in your area and have the attorney review your contract. Most real estate contracts have what is known as a "Time is of the essence clause", thus delays in the closing might be covered by your contract in general. But this is why I suggest you meet with an attorney who can put eyes on the contract and then give you specific advice.
