Q: Can I initiate a lawsuit against Apple, Inc. for negligence, regarding one of their employees stalking me via my iPhone?
My ex is a former Apple IT consultant who is still affiliated with Apple/Microsoft. When he began working for Apple, they did not conduct a background check pending his employment. Had Apple done so, they would have seen all the prior domestic violence charges, gun charges and violent crimes committed by my ex-boyfriend. My ex was given privileged access to the inter-workings of all "iDevices" and iCloud and has used his knowledge to stalk me through my Apple devices over the past year and a half. I reported this to Apple and their tech support team worked on my case for months. Apple replaced several of my devices without question....then they just sort of brushed me off. My ex continues to stalk me to this day and has done serious damage to me emotionally as well as destroying my finances. I feel that Apple is responsible for putting such power and privilege into the hands of a monster, yet they brush off my complaints and requests for action. Would this be a viable case in court?
A: Why not contact a member of the Az Trial Lawers who deals with assault and other harm cases and see what they say? If you can document all the contacts, saved them and /or downloaded them it's possible if they kept the guy on that they then bought into his conduct.
