Q: Our neighbor has violent outbursts. Can we ask for reimbursement for time spent away from our apt due to this?

Our upstairs neighbor has had 3 violent outbursts in the past 4 months which required the police to be called. On two occasions he has threatened violence on my husband and I. We now feel completely confined, trapped and terrified in our apartment. We don't open windows, spend time in our backyard and will remain inside if we see him outside our front door. During the work week we have been staying at our apartment, but every weekend for the past 3 weeks we have stayed at a relative's house for our safety. Are we able to submit for reimbursement for time spent away from our home due to this?

A: Ask? Certainly. Compel? Unlikely. Depending upon the exact facts, you may or may not have grounds to terminate your lease and you definitely need to maintain complaints to the landlord. You may also want to consider seeking a restraining order against the neighbor. If you qualify, even on a temporary basis, you likely will force the neighbor to move - immediately.
