Q: I am undocumented can I sue for food poisoning? or can I be deported ?

I had sea food at a local restaurant and got sick , initially owner said they will pay doctor bills and pay for my loss of wages, since I was off work for 5 days, they are now avoiding calls, I spoke to a personal injury lawyer and was told I could recover my medical cost fees and that my legal status would not cause any issues? Can I be deported if I sue I am in California
