Palo Alto, CA asked in Immigration Law for California

Q: can i stay beyond the 30 day grace period after completion of J1 training program if I have 212e waiver

I completed my training on a J1 visa on 6/30/2017 which is the end date on my DS-2019. I have obtained a 212e waiver for the 2 year home country requirement. I am awaiting my future employer to file for H1B. Can I stay beyond the 30 day grace period as the I-94 has "duration of stay" stamp ? I've been told both ways and I don't want to take a chance

A: It is best to error on the side of safety and not stay beyond the 30 grace period, that way you raise no issues and take no chances if you can make plans from now.
