Q: I lived with my boyfriend for six months. His father is the land owner but doesn't live there. I paid part of the bills
For 2 months until I lost my job. He told me he needed time to think and that I didn't need to be there when he came home from work. Can he just make me leave like that or does he have to file for an eviction with the courts? And if so, doesn't it have to be his father since he's the land owner?
A:
This is the legal answer: The father as the landowner can evict you. The son as the agent of the father-landowner can also evict you. The formal eviction process in Alabama requires a written notice or two followed by an eviction proceeding in court. If they go through all that you will lose and be evicted.
This is the practical answer: You live on Sand Mountain. In any rural area, and perhaps especially on Sand Mountain, the way things are done does not always follow the exact procedures required by the law. You could be in some danger, and you are also going to be evicted.
You're between a rock and a hard place. You don't have the money to hire a lawyer and if you did have the money, you'd lose and be evicted.
You can try calling Legal Services Alabama's statewide number, 866 456-4995 for assistance. They may or may not be able to help slow down the process.
WARNING: I am not your lawyer and providing you with the generic information, definition, clarification or explanation you seek about a legal matter on this anonymous forum does not make me your lawyer. By answering your question I am only trying to provide you with general information that will deepen your understanding of the legal concept that appears to be an issue for you, that will hopefully guide you in selecting and communicating with a lawyer of your choosing. The reason for all this is that legal problems are intensely fact-driven, and it is impossible to give anyone correct legal advice without comprehensive inquiry by the lawyer into the specific facts of the situation that concerns you, and the law of the jurisdiction in which you reside, and that is impossible to accomplish through this website. Even though I am not your lawyer, if I should later become your lawyer no representation is made that the quality of the legal services to be performed is greater than the quality of legal services performed by other lawyers.
