Flower Mound, TX asked in Animal / Dog Law and Personal Injury for Texas

Q: Bit by a pit bull. Dog came from yard into street as I was jogging by. Owner witnessed. Would h/o insurance cover loss?

Accident in VA, I live in TX. Not yet sure extent of injury but out of pocket expenses are likely about 2000 already (MRI yesterday, one week post-bite, because pain and limited function continues. Dr. suspects muscle tear). Not sure filing a suit is appropriate as owner was not Bill Gates, or even close. Hoping homeowners insurance can at least cover specials. Have owners name and address, but not phone number.

A: You asked an excellent question. With respect to dog bites, homeowner's insurance policies are hits and misses as to coverage. Many homeowner's insurance policies exclude personal injuries caused by a dog bite or dog attack. You should consult with a local attorney who most likely would be willing to send a letter out at no charge. Case would be handled on a contingency basis - no recovery - no attorney fees.

A: Many times it will cover. I suggest you contact a lawyer for direct advice.
