Q: I leased a home in FL. Never missed a rent payment. Landlord is breaking the lease to sell the home. What's my rights?

We leased a home in FL. Signed a one year lease agreement. Landlord tells us they are selling the home. This is 9 months into a 12 month lease. We are paid up on rent. We pay from the 15th to the 15th. We were out on the 22nd of the month but have paid up until the 15th of the previous month. Am I owed any proration? Also the landlord states that there were possessions left in the home that we took that belonged to them. However, the landlord stated that she didn't have time to move it all out as she moved in a rush and to do with it what we want when we moved in. We had everything professionally cleaned and spotless. Landlord claims that she will not return our deposit and prorated amount of money until her possessions are returned. There's no documentation stating that she left possessions in the home. The proration and security deposit is close to $2000.00. Just need to know our rights in the state of FL as tenants.

A: You need to consult with a landlord tenant attorney. The key first step is a review of the rental agreement as it likely has contract terms related to this type of situation. Also it does sound like she may have improperly handled the security deposit and a good landlord tenant attorney can help you there. But first step is the review of the contract.
