Q: Interstate or Foreign Support Orders & Accrued Interest Owed to the Parent

Is it common for CSE caseworkers not to comprehend the UIFSA? It's very frustrating. Even more confusing is trying to find legislation that answers a specific question.

The case in question has a past due amount of $44,750.00 and no payment has been made on the account since 2013. RI now has personal jurisdiction over the non-custodial parent, and the original child support order issued in MA.

When RI established personal jurisdiction over this case, and registered the foreign support order in 02/2017, they did not include the Massachusetts “Interest Owed to the Parent” which totals $5,900.00. Why?

RI allows interest to accrue on cases established in Rhode Island, so why wouldn’t Rhode Island include the “Interest Owed to the Parent” from MA?

Is there UIFSA/Federal or State legislation that supports this? Thank you.

A: It may have been as simple as a data processing oversight. That is a substantial amount past due. Hopefully, you have retained competent counsel to ensure the interest is properly perfected.
