Q: if you are paying child support doesn't that give the right to see and talk to your kids

A: Child support and timesharing are two separate issues, both governed by the court or by your written agreement with the other parent. If you cannot see or speak to your child then you need to go to court for help.

A: Child support and visitation typically are two separate matters or issues. The overriding factor for family cases involving children is the best interest of the child. If a person fails to pay child support, it is not in the best interest of the child, in most cases, to keep the child away from the parent who failed to or was unable to pay child support. All parties should follow the court orders as to child support and visitation. Otherwise, a motion can be filed to enforce the orders.
