A:
Hello and thanks for asking your question. So sorry to hear that you are having no luck dealing with the courts. The system can be very frustrating, at times! You have not provided a lot of detail with your questions, and I certainly do not want you to get too personal on this open website. I will do my best to answer you generally, about the procedures for motions in the New Jersey courts.
It sounds like you did the exact right thing: you sent your ex your motion paperwork via certified mail, return receipt requested and you indeed got the green signature card back. This means you followed the court rules. What should happen next, if it has not already, is that your motion should be scheduled to be heard by a judge, meaning, you should have gotten in the mail, a court date to appear. That green card will act as your proof that you served your ex properly and that she indeed received your paperwork, even though she decided, for whatever reason, not to answer your motion to terminate your permanent alimony.
At this point, I would call the courthouse in the county where your case is. Make sure that you are speaking to the matrimonial division when you call the court. You should ask the matrimonial (or FM) division why your motion has not been scheduled. It could simply be a result of the courts being very busy. Or, your case may have fallen through the cracks, unfortunately. It's rare, but that does happen.
If you need more detailed advice or further instruction on how to proceed in court, consider a consult with a family law attorney in your county, who knows not only the law, but the ins and outs of the county courthouse, judges and staff. This can be invaluable, especially when trying to get your case in front of a judge. Many attorneys offer free consultations, as we do. Hoping this was helpful and good luck! Regards, Bari
