Q: Owner came by and took down rotten deck and has left it in my yard for two weeks? what can I do?

I had a unattached deck in my yard that was rotten and was supposed to be removed before I moved in. The home insurance threatened to drop him and he came and cut it all down and has left it there. I have emailed and called and it has been two weeks and I have heard nothing. I've heard that I can pay the court until this is remedied and I have been looking at F.S. 83.63 Casualty Damage. He has only addressed one electrical issue since I moved in. There are not any proper outlets in the bathrooms. Which I have been told that will be done. And other issues too numerous to list. I have lived here for 9 months now and the time from the last issue he came and did not fix (he was suppose to return over the weekend but was never heard from ) was 7 months. I have a child that lives here and can not play in the backyard and I can not mow my grass because of debris and fear Iwill run over a nail or something. What can I do? Thank you very much.

A: best suggestion is for you to consult with a landlord tenant attorney in your area. step one is to have the attorney review your lease and then determine what is the next best step. If you have a year lease then you likely have 3 months to go on it and it appears that your landlord is not very well equipped to be a landlord and therefore this type of issue will likely persist in the future.

You need to hire a landlord tenant attorney to assist you in dealing with this landlord and be prepared that once you start making issues that the landlord will likely start trying to remove you from the lease (even if he does so improperly it will still be a big hassle for you so be prepared for that type of response).
