Fontana, CA asked in Child Custody, Family Law and Small Claims for California

Q: Bought iPad for 3yo daughter. She takes it everywhere. Ex is keeping her until custody hearing and will not return iPad.

My ex and I had a 50/50 verbal schedule for my 3 year old daughter. Until mediation, she will not return my daughter on days that I should have her and will only allow supervised visitation in her house. I bought my daughter an iPad for Christmas last year, I allow for her to take it to mother's house on her days. However, my ex will not return it me. What should I do?

(No I am not more concerned for the tablet than my daughter, I am doing everything and talking to lawyers, would just like to know about iPad as well).

A: The good fact is that you made a 50/50 agreement. The lack of follow through on the other parent will be questionable to the judge unless there is a good reason for supervised visitation. Filing a request for order for child custody and visitation is likely the necessary action to take which it sounds like it is in effect. You may need to file a small claims lawsuit for the iPad. More facts are required to provide a thorough analysis.
