Oakland, CA asked in Child Custody and Family Law for California

Q: I just found out my ex-husband was not free to marry I just divorced him 2 months ago he need to establish paternity

I want the sole custody of our daughter, however I was just informed he was not free to marry per child support and he need to establish paternity. Bad divorce he is with the mistress and giving me and current partner hard time. Mediation he only wanted 50% legal because he doesn't want her to fly out of country. sounds like y marriage was not valid and on paper no paternity is on file since marital presumption is not valid correct? I have temp restraining order on him court date is 10/16 I want to be able to full custody of daughter. he can have his 2 weekends out month that's all he wanted. please help what are my options

A: It doesn't sound like what he was asking for is unreasonable since it's not a lot of time, but more facts are required to provide a thorough analysis. Keep in mind judges could potentially grant him more time if the facts justify it, but more facts are required. The restraining order issue is of major concern and your protection is paramount. Seek a consultation with a local family lawyer to analyze the issues since these posts just don't provide the ability to analyze everything.
