Q: Apartment unliveable on move in date. We terminated b4 moving in. Are we liable?
The day we went to move into apt, it was filthy, bugs everywhere, air cond. Leaking from ceiling onto floors, what appeared to be mold throughout, hole in ceiling above hot water tank, etc. We took pics, went back to rental office, told them it was unliveable and we were not taking apartment. The office person called someone and they said OK and they would shred lease and check. Now they are suing us. Can they do that? What are our rights?

Depending on the amount, you may want to at least get the advice of an attorney who handles landlord tenant issues.Start by contacting legal aid. If you are over income for them ask if any of their attorneys who did housing issues are now in private practice. That's the person to call.
