Zephyrhills, FL asked in Employment Law for Florida

Q: Is FL strict on misclassification labor laws. i.e Employee/Independent Contractor

I just realized I have been classified as employee rather than Independent Contractor and I know there are hundreds of employees in the same position I am. Can I sue, because now I can't receive unemployment

A: Your question would depend upon detailed information. You need to consult with an employment law attorney to go over the facts of your case to determine if you have a claim to bring for yourself.

Good luck.

A: If you loose your job and you file for unemployment insurance, the Department of Workforce Development will determine whether you were an employee and are qualified for unemployment insurance. They won't just take the employer's word for it.
