Q: I am the non custodial parent and my daughter almost never stays with me overnight but I visit at least once a week.
My ex has filed for child support and I’m being taken to court. When we went to mediation they said I could pay up to $520. I can’t afford that and she won’t budge because all she sees is dollar signs. I’m not against paying Child support but I need to be able to afford it. How do I get the judge to see that in court?
A: Child support is calculated according to guidelines based on your incomes. If $520 is the proper guideline amount based on your income, then you are likely making around $2500 a month or more and can afford it. It may not fit in with your current expenses but that is basically just too bad. You are likely just going to have to simply make some changes and by changes I mean cut backs in other expenditures. If you want to deviate from guidelines and get a judge to agree with you that $520 is just too much for your share to feed, clothe, house, educate and properly take of a child then you had better have a really really good explanation such as you have life saving medical expenses - your current housing and car payment costs won't cut it
